When to use this template

Use it for mediation, settlement conference, or formal negotiation session — in-person, Zoom, or by phone. The structure handles both an ongoing negotiation (positions, offers, sticking points) and a finished one (terms, outcome). For early-stage case strategy, see Case Strategy. Fields captured

  • Matter name — the case or deal identifier.
  • Mediator / facilitator — the third-party neutral, if any.
  • Parties present — each party, role, and who they were represented by.
  • Opening positions — each party's initial demand or offer.
  • Offers and moves — each offer (from, to, offer, response).
  • Key issues in dispute — what is left to negotiate.
  • Sticking points — places both sides dug in and would not move.
  • Areas of agreement — what is already settled.
  • Final outcome — settled, recessed, impasse, etc.
  • Settlement terms — if settled, the operative terms agreed.
  • Next steps — concrete tasks with optional owner and due date (drafting, execution, payments).
  • Key takeaways — the AI's prioritized summary points.
